Appeal court confirmed the judgement in favor of client in lawsuit about illegality of spending UAH 3.3 million.
The appellate court agreed with the conclusions of the local court on the legality of spending funds by a condominium association, which were raised for a repair of a foundation of a multi-apartment building by the decisions of the general meeting of the association of co-owners. The court refused to conduct technical- construction and economic examinations at the request of the appellant. The court dismissed to declare as illegal spending of deposits. The compensation of attorney's fees from the plaintiff in favour of the client was agreed.
