New case / Cancellation of the raider ownership of a 6-room apartment in Kyiv.

The client’s order was accepted to protect the rights to an inherited 6-room apartment on Lobanovsky Avenue. After opening the inheritance in 2023, it has been revealed that the husband’s apartment was registered in 2022 in the State Register of Property Rights in the name of a third-party “buyer” based on a sale-purchase agreement from 2012.

Therefore, the real estate is not formally included in the inheritance, and the notary refused to issue the client a certificate of inheritance for it.

From the responses to the lawyer’s inquiries, it was found that there is no notarial archive of the notary Kudarenko V.M., who allegedly certified the sales agreement. Thus, it is impossible to verify the fact of the conclusion, as well as the subject and parties of this transaction in the notarial case and register of this notary.

The criminal case on the fact of fraud revealed that the raiders forged the passport of the "buyer" using the data of the real passport of a third party.

The lawsuit was filed with the court to cancel the registration of the property right in the name of the raider and recognise the client's property right by inheritance after the death of her husband.
