In the legal proceedings completed one year ago, a division of a detached house with an area of 194 sq.m. was achieved after divorce, and 65/100 of the premises of the house were awarded to the client. However, the real estate is located on a land plot that is in the personal ownership of another person (former spouse), since it was granted to the defendant during marriage, and not purchased as joint property of the spouses. At the same time, the awarding of the client the right to use this land plot (easement) for access to her part of the house was cancelled by the appellate court.
Therefore, due to the lack of confirmation of the client’s legal rights to the land plot and the defendant’s denial of her entry into the house, a new lawsuit had to be filed for the division of the land plot.
