New case / Declaring invalid a sale of real estate on "SETAM" auction.
All property sales in enforcement proceedings in Ukraine are provided exclusively by the state enterprise "SETAM". Debtors' property is being sold on electronic auctions. According to the established procedure, when submitting the last price offer 5 minutes before the end of electronic bidding, the auction is automatically extended for 30 minutes. Sale of real estate by the bank was announced at auction from 9:00 to 18:00.
During the client’s fight with a competitor until the last seconds, the auction was ended by the state enterprise "SETAM" at 18:25 after the competitor's offer.
The premature end of the auction for 5 minutes did not allow the client to raise the rate and buy real estate.
A lawsuit was filed to declare the auction invalid on the grounds of violation of the procedure and a solicitation for securing the claim is submitted to the court.
A trial is expected.
